JUSTICE RAJIV ROY ORAL ORDER 06-02-2023 Heard learned counsel for the petitioner and the learned APP for the State The petitioner apprehends his arrest in connection with Bahadurpur P.S. Case No.221 of 2020 instituted under Sections 341, 323, 354(B), 354(C), 354(D) and 34 of the Indian Penal Code and Section 8/12 of POCSO Act As per the FIR, the informant alleged that his brotherin-law's daughter, victim was staying with him and was in the field grazing buffalo when the accused persons after consuming liquor were also there and further at the instance of the petitioner, Jitendra Ram caught hold of her dragged her on the point of knife while Rahul Singh took her pictures. When Rakesh Kahar objected to this, he was assaulted by all of them making him unconscious. As the people gathered, they escaped.

A perusal of the petition would show that the trial of some of the accused is already on vide Session Case No.POCSO GR-21/2020. In that backdrop it would be appropriate for the petitioner to surrender within four weeks from today and pray for bail and in that event the same shall be decided on its merit without being prejudiced by any comments/observations made herein.

So far as the anticipatory bail is concerned, considering the fact that one of the allegation is under POCSO Act and the trial is on, this Court does not deem it fit to extend the same, which is accordingly rejected.
