The petitioner being the husband of the complainant is languishing in custody since 25.02.2016 in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 323, 379, 307, 498A/34 of the Indian Penal Code.
The basic accusation is of torture.
On instruction it is submitted by learned counsel for the petitioner that petitioner admits the marriage with the complainant and he is ready to keep the complainant as wife with full dignity and honour. Statement to that effect has been made in para- 7 of the petition which reads as follows:- "That the petitioner is the husband of the complainant/opposite party no. 2 herein. In all fairness and with

No.16871 of 2016 (2) dt.19-04-2016 a sense of purpose, this is being stated that the petitioner is ready to keep his wife/opposite party no. 2 with full respect and dignity and security. But at the same time this is being clarified that the petitioner shall not move on to the in-laws house or to a separate house leaving alone his parents and other family members. "
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Saran at Chapra in connection with Complaint Case No. 1395 of 2013.
