JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 22-04-2015 The two Finance Officers of B.N. Mandal University, Madhepura, being the past and present are personally present before this Court. They stated that order of this Court have been finally complied with. Learned counsel for the petitioners fairly concedes that now the ordeal is over.
Ordinarily, I would have closed this proceeding at this stage itself, but considering the fact that the writ petition was allowed in the year 2010 with a direction that all similarly situated persons should be accordingly dealt with. Still, it has taken five years for the University to comply with those directions not only that,
Patna High Court MJC No.4690 of 2013 (10) dt.22-04-2015 this contempt application was filed in the year 2013. The order-sheet would reveal that the number of times there were personal appearances and undertaking to full comply with the directions of this Court which were never complied with.
In that view of the matter, while disposing of these contempt proceedings for the harassment caused to the petitioner and wastage of court's time, I direct the University to pay a cost of Rs. 25,000/- (Twenty Five Thousand) to be deposited with Patna High Court Legal Services Committee, within ten days from today. It shall be the duty of the Vice-Chancellor of the University to see as to who were the officers responsible for this inordinate delay and realize the said amount from them having paid it to the High Court.
