JUSTICE SHIVAJI PANDEY ORAL ORDER 04-03-2015 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in Purnahiya P.S.Case No. 25 of 2013 registered u/s 147, 148, 149, 427, 436, 341, 323 IPC, 17 of CLA Act and 27 of the Arms Act. Allegation in the FIR is that the informant was sleeping in a room. He was forced to come out and informed that 40-50 persons covering their faces were standing and later on set the tower on fire by pouring petrol. Petitioner is in custody since 17th December 2013.

Looking to the period of custody, petitioner Sanjay Patel is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sheohar in

Patna High Court Cr.Misc. No.2529 of 2015 (3) dt.04-03-2015 2/2 Purnahiya P.S.Case No. 25 of 2013, with the conditions that (i) one of the bailors will be the father/mother/wife of the petitioner, (ii) if the petitioner would be found involved in similar type of case in future, prosecution will be at liberty to file application for cancellation of bail and the court below will pass necessary order, including cancellation of bail bonds and (iii) that the petitioner would cooperate in the proceeding and if the petitioner will fail to co-operate in the proceeding of the court below and will remain absent for two consecutive dates without reasonable explanation, the court below will pass appropriate order, including cancellation of bail bonds.
