JUSTICE SUDHIR SINGH ORAL ORDER 20-05-2015 The petitioner is apprehending his arrest in connection with Sheikhpura P.S. Case No. 387 of 2013 for the offences instituted under Sections 409, 420, 467, 468, 472 and 474 of the Indian Penal Code.
Heard learned counsel for the petitioner, State and learned counsel for the informant.
The prosecution story, in brief, is that the informant has executed an agreement B.S.F.C.I., for the year 2013 and as per agreement 6090 sacks of paddy was recommended for supply, whenever the informant used to lift the paddy from purchase centre, Sheikhpura, he himself used to write and sign on it. On 08.08.2013 the informant was called by the petitioner and his

No.50015 of 2014 (3) dt.20-05-2015 2 / 3 signature was obtained on three papers and the petitioner asked him to supply later on, then the informant cut his signature on the above form. Later on the informant got an information that the petitioner in order to grab the paddy himself wrote that the paddy has already been lifted. The informant also made complaint to higher official but it was fruitless then he lodged this case. It has been submitted on behalf of the petitioner that the petitioner is the Manager of B.S.F.C.I. godown, Sheikhpura, It has further been submitted that the petitioner has no criminal antecedent. Further it is submitted that the petitioner is ready to deposit amount of Rs. 50,000/- in the court below which shall be subject to final disposal of the case.
On behalf of the State and the informant, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances that the petitioner is ready to deposit amount of Rs. 50,000/- in the court below which shall be subject to final disposal of the case, let the above named, petitioner, be released on bail in the event of his arrest or surrender before the learned court below within a period of eight weeks from today in connection with Sheikhpura P.S. Case No. 387 of 2013 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.50015 of 2014 (3) dt.20-05-2015 3 / 3 satisfaction of the learned C.J.M. Sheikhpura, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
