JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends her arrest in connection with Narhat P.S. Case no.117 of 2016, registered under Section 366(A) of the Indian Penal Code.

The accusation is of kidnapping of the minor daughter of the informant by Rajesh Kumar, son of the petitioner, with the help of the petitioner for the purpose of marriage.

Learned counsel for the petitioner submits that in the statement recorded under Section 164 of Cr.P.C. of the victim in which she has stated about her kidnapping by five boys, including Rajesh Kumar, son of the petitioner, and taking her Gaya, where this petitioner came and asked to kill, but she was taken to Mumbai and from Mumbai, she was taken to Patna, except that there is nothing against the petitioner. Further submission is that, in fact, petitioner lodged Narhat P.S.

No.2406 of 2017 (2) dt.14-02-2017 2/2 informant and others and due to that reasons, the victim, daughter of the informant, disclosed the name of this petitioner in her statement recorded under Section 164 of Cr.P.C. without any specific overt act along with the name of son of the petitioner and others having hand in the kidnapping of the daughter of the informant. The petitioner is a lady and she has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-III, Nawada in connection with Narhat P.S. Case No. 117 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
