JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-08-2018 Earlier prayer for bail of the petitioner was dismissed vide order dated 08.08.2017 passed in Cr.Misc. No. 33260 of 2017 in connection with Laheria Sarai P.S. Case No. 108 of 2017 and there was allegation that she has provided petrol to the co-accused of this case, who sprinkled the same on deceased and set her on fire, causing her death.
Submission of learned counsel for the petitioner that other co-accuse, who is mother of the petitioner and was having similar allegation has already been enlarged on bail vide order dated 10.08.2017 passed in Cr. Misc. No. 38041/17 and petitioner has been in judicial custody since long.
Heard learned A.P.P. as well a learned counsel for the informant, they have opposed the prayer for bail and submitted
Patna High Court Cr.Misc. No.39417 of 2018 (3) dt.01-08-2018 2/2 that only three witnesses have remained to be examined in this case and the order passed by this Court has also been affirmed by the Hon'ble Supreme Court.
Having heard both sides, from perusal of the record, it appears that the petitioner has also moved before the Hon'ble Supreme Court and the Hon'ble Supreme Court has also inclined to interfere with the order passed by this Court, however, observed that the petitioner will be at liberty to renew her prayer for bail after nine months. In view of the above facts, let the petitioner above named, be enlarged on bail on furnishing bail bonds of Rs. 25,000/- ( Rs. Twenty Five Thousand) with two sureties of like amount each to the satisfaction of learned 1st Additional Sessions Judge Darbhanga in connection with Laheria Sarai P.S. Case No. 108/17, subject to the condition that petitioner shall cooperate in the disposal of trial and shall appear as and when required by the court, failing which, the prosecution shall move for cancellation of her bail bonds.
