JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-03-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioner apprehends their arrest in connection with Chiraiya P.S. Case No. 267of 2015 registered under Sections 304B/34/201 of the Indian Penal Code. The accusation is that on 19.02.2009, marriage of sister of the informant was performed with Hari Mohan Chaurasia and, after passing 2 and 1⁄2 years, she gave birth of a baby. Thereafter, she was being tortured for demand of motorcycle and she-buffalo. On 19.12.2015, the informant came to know that his sister was killed.

Patna High Court Cr.Misc. No.2527 of 2017 (2) dt.07-03-2017 2/2 Learned counsel for the petitioners submits that admittedly, the deceased sister of informant died after 7 years of the marriage. In fact, sister of informant died in natural death but with ulterior motive, this false case has been lodged implicating the petitioners who are brothers-in-law of the deceased and used to reside separate to the husband of the deceased.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran in connection with Chiraiya P.S. Case No.267 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Vats/- U T
