The petitioner seeks bail in connection with Town P.S. Case No. 822 of 2021 instituted for the offences under Sections 30(a) and 41 of the Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 07.08.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that allegation is of recovery of 130.86 litres of liquor from a Honda Car.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 07.08.2021, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Nawada in connection with Nawada Town P.S. Case No. 822 of 2021.
