JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends her arrest in connection with Belsand P.S. Case No. 24 of 2019 registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

Petitioner happens to be Gotini of the deceased and no specific overt-act has been attributed against her in first information report. The informant claims in her written report that when she along with her son reached at the house of the petitioner, she saw that her girl was being burnt alive by the petitioner and other in-laws of her daughter but in course of investigation, when the statement of son of the informant was

Patna High Court CR. MISC. No.53068 of 2019(3) dt.16-11-2019 2/2 recorded, he claimed that when he along with his mother reached at the place of occurrence he saw that dead body of his sister was being burnt. Moreover, husband of the petitioner has already been granted privilege of anticipatory bail by a coordinate Bench of this court vide order dated 26.08.2019 passed in Cr. Misc. No. 53207 of 2019.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of her arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Sitamarhi in Belsand P.S. Case No. 24 of 2019, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
