JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code and Section 3 (I) (XI) of the SC/ST (Prevention of Atrocities) Act.
The accusation is of kidnapping the minor daughter of the informant.
It is submitted by learned counsel for the petitioner that though, the victim in 164 Cr. P.C. statement, where the victim got her age recorded as 19 years when the court also assessed as such, stated that the petitioner married with her forcefully but she admitted that she went in the company of the petitioner of her own. Moreover, the informant has subsequently retracted from his initial version and filed a petition to that effect before the learned
Patna High Court Cr.Misc. No.3432 of 2015 (2) dt.27-01-2015 2/2 court below. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Barh at Patna in connection with Mokama P.S. Case No. 200 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
