JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The trial court has reported that case of the petitioner is pending for receiving of the police paper and, therefore, it appears that uptill now, charge could not be framed against the petitioner, who is languishing in jail custody since 05-03-2015 i.e. for more than a year.

No doubt, petitioner is said to have been caught with stolen motorcycle after the alleged occurrence but the petitioner does not have any criminal antecedent and trial of the petitioner is not going to be concluded in near future.

Accordingly, the petitioner named above, is

Patna High Court Cr.Misc. No.17554 of 2016 (3) dt.24-08-2016 2/2 directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Industrial Area P.S. Case No. 25 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur.
