2. The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 324, 307, 506, 504, 34 of the Indian Penal Code.

The prosecution case, in brief, is that on 05.12.2020 at about 9:30 PM, the informant was going to attend a Barat and reached near a petrol pump, where he saw that Barat was about to start, so he parked his Scorpio there, in the meantime, the accused persons named in the F.I.R. including petitioners came and started assaulting him with fists & hand. Petitioner no. 2

Patna High Court CR. MISC. No.60292 of 2025(3) dt.09-10-2025 2/3 assaulted informant with iron rod, whereas petitioner no. 3 assaulted brother of informant with knife and petitioner no. 1 & other co-accused assaulted informant and his brother with fists & slaps.

Learned counsel for the petitioners submits that as per F.I.R., the date of occurrence is 05.12.2020, but F.I.R. has been lodged after a delay of 12 days on 17.12.2020 and there is no plausible explanation of delay. As per injury report, the injuries, sustained by informant and his brother, are simple in nature. Petitioners claim clean antecedent, as per statement made in paragraph - 3 of the supplementary affidavit.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the nature of injury and clean antecedent, the prayer for anticipatory bail of petitioners is allowed. Let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Chanpatia P.S. Case No. 641 of 2020, subject to condition as laid down under Section 438(2) of
