The petitioner seeks pre-arrest bail in connection with Case No. 232c2 of 2014 for the offences alleged under Sections 33, 41 and 42 of the Indian Forest Act.

In course of patrolling, the informant, being the Vanpal, found excavating of stone, measuring 40' x 30' x 13' for road construction. On query, names of four persons came to light, including the petitioner.

The submission of the learned counsel for the petitioner is that it would appear from the criminal report that neither the petitioner nor his vehicle were found on the spot. Mere on suspicion, the petitioner and four others have been implicated by the informant, who is the Vanpal.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Case No. 232c2 of 2014 shall be released on pre-arrest bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Amrendra Kumar Raj, Judicial Magistrate, 1st Class, Jamui, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
