JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-03-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Adaura P.S. Case No. 65 of 2016, registered under Sections 341, 323, 504, 307 and 427/34 of the Indian Penal Code. The accusation is that, on 21.11.2016, Ramdhar Snigh Yadav (petitioner no.1) was grazing cattle in the field of informant, Bhagban Das Singh. When Radhika Devi, wife of the informant, made protest then Ramdhar Snigh Yadav (petitioner no.1), his wife Basmati Devi and Hare Krishna (petitioner no. 2) started to abuse and caused injury to Radhika Devi, wife of the informant.

Learned counsel for the petitioners submits that

Patna High Court Cr.Misc. No.5916 of 2017 (2) dt.28-03-2017 petitioners have falsely been implicated in this case due to land dispute and the informant is not the eye witness to the occurrence. Moreover, two injuries were found on the wife of the informant, which are simple in nature and petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabhua, in connection with Adaura P.S. Case No. 65 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
