JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-04-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The accusation against petitioner no. 1 is that he made the son of the informant captive in his house and when informant made enquiry about his son, he found that his son was missing.The contention on behalf of the petitioner no. 1 is that as a matter of fact, the son of informant eloped with daughter of the petitioner no.1 for which petitioner no.1 gave a written report to the concerned officer in -charge of Muffasil police, station but the F.I.R of the petitioner no. 1 was not registered and later on, police in collusion with the informant of the present case registered Muffasisl P.S.Case No.400 of 2013 against petitioners and others

Patna High Court Cr.Misc. No.50982 of 2014 (4) dt.16-04-2015 2/2 and made attempt to arrest the petitioner no. 1 but the villagers raised objection for which police registered Muffasil P.S.Case No. 190 of 2014 against petitioners.

No doubt, the victim of the present case is still traceless but the investigation has already been completed in respect of petitioner no. 1 namely, Bhola Mahto and petitioner no. 2 namely, Yosoda Devi.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sadar, Motihari, East Champaran, in connection with Muffasil P.S.Case No. 400 of 2013.
