JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-06-2018 The petitioner is apprehending his arrest in connection with Kothi P.S. Case No. 38/14, registered for offences punishable under Sections 147, 148, 149, 341, 323, 307, 354, 436 of the Indian Penal Code and 27 of the Arms Act as well as Section 17 of C.L.A. Act.

Allegation against the petitioner that he entered along with other persons in the house of the informant and was asking for her son and when they did not find him, they tried to set the house of on fire, thereafter, police arrived and they fled away. It has been submitted on behalf of the petitioner that he is not named in the F.I.R, his name has transpired during the course of investigation on the basis of confession of co-accused and except that there is nothing against the petitioner.

Having heard both sides, considering the facts and circumstances of the case as well as the nature of accusation, I am not inclined to grant the privilege of anticipatory bail to the petitioner. This application is, accordingly, dismissed. Petitioner, if so desire, may surrender before the court below and pray for regular bail and if any, such application is filed, the court below shall pass an appropriate order on the merit of the case, without being prejudiced by the order of this Court.
