The petitioner has prayed for bail in a case registered for the offence punishable under sections 8(c), 21(b), 25 and 29 of Narcotic Drugs and Psychotropic Substance Act. Prosecution case relates to recovery of 50 gram Heroine from joint possession of the petitioner and one other accused kept under the seat of Hero Honda.
It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. No incriminating article has been recovered from conscious possession of the petitioner. He has been implicated in this case on the basis of self confessional statement before the police,
Patna High Court CR. MISC. No.58404 of 2022(3) dt.25-02-2023 2/2 which has no evidentiary value in the eye of law. Allegedly, there is recovery of 50 gram Heroine, which comes below the commercial quantity. He is languishing in judicial custody since 23.03.2022.
The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Special Judge NDPS Act, Bhojpur at Ara in connection with NDPS Case No. 49 of 2022 arising out of NCB Case No. 09 of 2022.
