The petitioner apprehends his arrest in Complaint case No. 2503 of 2015 under Section 498A/34 of the Indian Penal Code and under Section 3⁄4 of Dowry Prohibition Act. The complainant alleged that she was married to the petitioner in the year 1996 but her husband demanded additional dowry and drove her out from the house. She alleged that she got two children, one is aged about 15 years and another is aged about 13 years but her husband fled away to Punjab leaving the complainant to her Naihar.
The learned counsel for the petitioner submits that petitioner never tortured his wife. His wife voluntarily left his house and went to her Naihar. She gave letter (annexure-2) that she was going to work in a factory. She took money from different

Considering the fact that after 19 years of marriage the complainant has filed this case and children of complainant are living with their father, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sunil Kumar-III, learned Additional Chief Judicial Magistrate-V, Katihar in Complaint Case No. 2503 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
