JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406, 420, 354, 327 and 120B of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.
It is alleged that the informant's son was appointed as Assistant Forest Guard on monthly salary of `3,000/- per month but the same was not paid and when the informant went to demand the same, she was asked to satisfy the lust of the petitioner. It is submitted by learned counsel for the petitioner that a complaint was earlier made to the Assistant Conservator of Forest when the enquiry was made and it was found that the informant herself was demanding money from the Forest officials. Considering the enquiry report, as contained in
Patna High Court Cr.Misc. No.4286 of 2015 (2) dt.02-02-2015 2/2 Annexure-5, which reflects that the informant herself was demanding money, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Jamui in connection with Jamui SC/ST P.S. Case No. 18 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
