The petitioner seeks bail in a case registered under Sections 304B, 498A, 302/34, 120B, 149, 201 of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act.

Allegation is that the accused persons including the petitioner caused death of the daughter of the informant due to non-fulfilment of demand of dowry.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 3.4.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The petitioner has referred paragraphs 8 and

Patna High Court Cr.Misc. No.41871 of 2018(3) dt.06-08-2018 2/2 14 of the case diary. It is a case of accidental death. On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. S.D.J.M., Sadar, Motihari, East Champaran in connection with Rajepur P.S. case No.137 of 2015.
