The only reason why the petitioner has approached the High Court is because the order and direction issued by the Divisional Commissioner, Gaya in Appeal No. 33 of 2010, passed on 14.03.2011 has not been implemented or carried out by the District Magistrate, Gaya.

It is rather unfortunate state of affairs, if what has been stated by the petitioner is correct that a superior authority's adjudication and direction has not been implemented in the last 3 to 4 years. It is a poor

Writ application is now disposed off with a clear direction upon the District Magistrate, Gaya that he has other responsibility and obligations besides running the administration and monitoring the law and order situations. He must carry out the direction of the Divisional Commissioner without fail within a period of three months from the date of production / communication of a copy of this Order..

Writ application stands disposed off with observation / direction as above.
