This is a petition for grant of anticipatory bail for offence under Section- 7 of the Essential Commodities Act. The petitioner is a PDS dealer. Allegation is that some consumers have made complaint that they are not receiving the goods from the PDS of this petitioner.
Submission of the petitioner is that the petitioner has got no criminal antecedent. He is a PDS dealer since 1986 but no such complaint was ever made against the petitioner in the past and the complaint is only oral one without verification of the records.
Considering the above said facts and circumstances as
Patna High Court Cr.Misc. No.5241 of 2017 (2) dt.23-02-2017 2/2 well as submission of the parties, let the petitioner named above in the event of his arrest or surrender in the court below within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Madhepur P.S. Case No. 81 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate, Jhanjharpur subject to the condition as laid down u/S 438(2) of the Cr.P.C.
