SONI SHRIVASTAVA ORAL ORDER 28-07-2025 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the complainant. Despite issuance of notice to the opposite party no. 2, she has not appeared in the present proceeding.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 504, 498A of the Indian Penal Code.
3. Allegation in the first information report is that the members of the family of the petitioner excluding him, were demanding dowry and were also indulging in torture. Petitioner is the husband of opposite party no.2.
4. Learned counsel for the petitioner submits that it would be evident from the first information report itself that the

No.61302 of 2024(11) dt.28-07-2025 2/2 petitioner, who is husband of the opposite party no. 2, was not even named as accused in the FIR and subsequently name of the petitioner has transpired as an accused during the course of investigation. It is further submitted that all the other accused persons, who are the family members of the petitioner and inlaws of the informant, have already been granted bail by the same order of the learned court below by which the application of petitioner has been rejected.
5. Taking into consideration the fact that the petitioner was not even named in the first information report, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Imamganj P.S. Case No. 11 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C./482(2) of the B.N.S.S.
