The petitioner apprehends her arrest in Jamalpur P.S. Case No. 98 of 2014, registered for the offences punishable under Sections 498A, 406, 307 and 34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

The husband and wife are present. Learned counsel appearing on behalf of petitioner submits that the petitioner is ready to keep his wife. The wife is also ready to live with the petitioner, but it is submitted on behalf of the learned counsel for informant that the conduct of the husband is not good as he always assured to keep his wife, but did not took his wife to his house. Considering the facts that the husband and wife are willing to live together, the petitioner is directed to surrender

Patna High Court Cr.Misc. No.3710 of 2015 (3) dt.12-02-2015 2/2 before the court below and the court below shall grant provisional bail for one month to the petitioner on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Biraul, Benipur, Darbhanga in connection with Jamalpur P.S. Case No. 98 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. with a direction to the petitioner to take his wife and keep her properly thereafter the court below shall fix a date after one month. If the dispute between the husband and wife is amicably settled the provisional bail granted to the petitioner shall be confirmed and if the dispute between the husband and wife is not resolved the court below shall pass order on bail of the petitioner on its own merit.
