JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-05-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The petitioners are accused in Amdabad P.S. Case No.39/15 registered under Sections 302, 120(B)/34 of the I.P.C. and 27 of the Arms Act.

Learned counsel for the petitioners submits that it would appear from the F.I.R. that before death father for the informant had named eight persons including the petitioners having hand to shot fire at him. He further submits that the petitioners have no criminal antecedent and they are in custody since 8.12.2015 whereas similarly situated co-accused, Chandan Sah and Kundan Sah, Ritesh Singh have been allowed bail vide

Patna High Court Cr.Misc. No.16026 of 2016 (3) dt.20-05-2016 2/2 Cr.Misc. No.33007 of 2015 on 5.10.2015 and Cr.Misc. No.56683 of 2015 on 29.4.2016 respectively.

Having regard to the facts and circumstances of the case, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the C.J.M., Katihar in Amdabad P.S.Case No.39/15.
