The petitioner is apprehending his arrest in a case registered under Section 498A of the Indian Penal Code. The wife made allegation that her husband assaulted her only because he wanted the complainant to bring money from her parents. She further alleged that the petitioner drove her out after snatching her belongings.

Learned counsel for the petitioner submits that the marriage was solemnized in the year 2002. After ten years, the present complaint case was filed. The complainant had earlier filed Case No. 87 of 2010 and compromise was arrived at between the parties. The complainant is the sole child of her parents and

Patna High Court Cr.Misc. No.3513 of 2015 (2) dt.27-01-2015 2/2 she wanted to live in her Naihar, that is why, this case has been lodged only to put pressure on the petitioner so that the petitioner may also live with her in her Naihar.

Having considered the facts that after ten years of marriage, the present complaint case has been filed and even during that period there was a dispute between the parties and compromise was arrived at between the parties, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarge on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Nawada in Complaint Case No. 549 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
