JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-03-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner seeks bail in a case for the offences punishable under sections 302 and 201/34 of the I.P.C Guddi Devi, the sister of the informant, was married to the petitioner eight years ago and always the husband and wife used to quarrel and on 19.03.2014 the petitioner and other coaccused killed Guddi Devi and burnt the dead body. No information was given to the informant in this regard. Submission is of false implication and that there was cordial relation between the petitioner and his wife, the wife of the petitioner died due to rapture of appendicitis, the informant after realizing the truth has filed compromise petition in the court of the

Patna High Court Cr.Misc. No.2597 of 2017 (3) dt.10-03-2017 2/2 learned S.D.J.M. Sherghati, Gaya alleging innocence of the petitioner and as such the petitioner having no criminal antecedent deserves sympathetic consideration as he is in custody since 20.10.2016.

The learned A.P.P. submits that now the informant is retracting from his earlier version.

In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M. Sherghati at Gaya in Imamganj P.S. Case No. 24 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
