JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners were caught in a field when police went on the place of occurrence and, admittedly, no firearm was recovered from conscious possession of the petitioners nor there is any allegation of making firing against them. Moreover, petitioners do not have any criminal antecedent and they are languishing in jail custody since 02.03.2016.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate,1st, Khagaria in connection with Parbatta ( Maraiya) P.S.Case No. 43 of 2016.
