Petitioner seeks bail in a case registered under sections 363, 366, 366A, 376/34 of the Indian Penal Code as well as section 3 ( 1) (XII) of the SC/ST Act.

Informant claims that she was kidnapped by Sujit Kumar and one unknown person on 30.8.2015 and after that the aforesaid Sujit Kumar in presence of the petitioner and others put vermilion on her forehead and took her to Punjab where she was raped by the aforesaid Sujit Kumar as a result of which she became pregnant and telephoned her father. Informant further claims that she was brought to her village by the aforesaid Sujit Kumar and after that she lodged the present case on 2.12.2015 i.e. near about four months of her kidnapping.

Petitioner happens to be father of the aforesaid Sujit Kumar

Patna High Court Cr.Misc. No.15823 of 2016 (2) dt.20-04-2016 and it is alleged that he also helped the aforesaid Sujit Kumar in kidnapping the victim.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Sursand P.S. Case no. 285/2015.
