As there is a direct allegation against the petitioner, this Court is not inclined to grant him bail but, the court below is directed either to ensure appearance of Bimali Devi and proceed with the trial on day-to-day basis. In the event, Bimali Devi is not secured, the court below will separate the case of Bimali Devi and rest of the accused persons and conclude the trial on day-to-day basis.

It is expected that the trial court will conclude the entire process within a period of nine months from today. With the aforementioned observation, this application for bail is dismissed.
