JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324 of the Indian Penal Code and Section 27 of the Arms Act. Petitioners are named in the first information report on the accusation that they made indiscriminate firing whereas other accused being armed with different weapons assaulted the injured persons of this case.
Learned counsel for the petitioners points out that three persons are said to have sustained injury in the alleged occurrence but none of the injured sustained injury, said to be
Patna High Court Cr.Misc. No.17415 of 2016 (2) dt.29-04-2016 2/2 caused by firearm. Moreover, petitioner no. 1 lodged criminal case against the prosecution party for the occurrence of the same day. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Ashish Ranjan, Judicial Magistrate 1st Class, Araria in connection with Fulkaha P.S.
