2. The petitioner seeks bail in connection with Khaira P.S. Case No. 136 of 2024 registered for the offence punishable under Sections 302, 201, 120B / 34 of the IPC.
3. The petitioner is the husband of the deceased. He is alleged to have killed the deceased for demand of dowry and is in jail since 29.04.2024.
4. It has been submitted by the learned counsel for the petitioner that the deceased died of natural causes. The marriage is ten years old and the couple have two children who are staying with the family of the petitioner.
5. Considering the fact that the marriage is ten years old and there are two children born out of the wedlock of the
Patna High Court CR. MISC. No.60672 of 2024(3) dt.20-11-2024 2/2 petitioner and deceased, who are staying with the family of the petitioner, this application is allowed.
6. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Jamui in connection with Khaira P.S. Case No. 136 of 2024.
7. At the time of accepting the bail bonds of petitioner, the Court below is directed to verify the statement of the petitioner that the children are staying with the petitioner's family. If the trial Court finds that the children are staying with the petitioner's family then the bail bonds of the petitioner shall be accepted and if the trial Court finds that the children are not staying with the petitioner's family then the bail bonds of the petitioner shall not be accepted by the Court below.
