JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2019 This application, for grant of anticipatory bail, arises out of Barbigha P.S. Case No. 118 of 2019, disclosing offences under Sections 401, 379/34 of the Indian Penal Code. Prosecution case is that motorcycle of the informant was stolen away. Later on one persons was apprehended with the motorcycle and on search, three master keys were recovered from him and he disclosed the name of petitioner as his associate, who were engaged in commission of theft of motorcycle.

Submission of learned counsel for the petitioner is that save and except the confessional statement of co-accused, there is nothing against the petitioner and further there is no recovery from the petitioner.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura, in connection with Barbigha P.S.
