The petitioner apprehends his arrest in Muzaffarpur Sadar P.S. Case No. 316 of 2014, registered for the offences punishable under Section 395 and other Sections of the Indian Penal Code.
The informant alleged that he along with other traders purchased 45 cows and calves and loaded the same on two trucks. Four persons came on two motorcycles and with the help of villagers forcibly took away all the 45 cows and calves. They also robbed cash and another articles from the possession of the informant and other traders and set ablaze the truck. Learned counsel for the petitioner submits that the petitioner is not named in the FIR. For the same occurrence
Patna High Court Cr.Misc. No.4003 of 2015 (2) dt.29-01-2015 Muzaffarpur Sadar P.S. Case No. 317 of 2014 was registered under Section 11 (K) (D) of Animal Cruelty Act against the informant.
Considering the facts aforesaid and the fact that one looted cow was recovered from the Darwaja of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
However, the petitioner, if so advised, may surrender before the court below within four weeks and pray for regular bail and his prayer for regular bail shall be considered on its own merit on the same day without being prejudiced by this order. (Prabhat Kumar Jha, J.) KKSINHA/- U T
