JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2019 This application, for grant of anticipatory bail, arises out of Barbigha P.S. Case No. 105 of 2019, disclosing offences under Sections 401, 414, 379/34 of the Indian Penal Code. Police on information that two persons were standing in suspicious condition went there and on seeing the police one of the accused succeeded in fleeing away, while another was caught and on search, three master keys were recovered from him and he disclosed the name of petitioner as his associate, and he disclosed that they belong to a gang of robbers of bike and their leader is petitioner, who succeeded in fleeing away. Apart from that it appears that petitioner is accused in one more case.

Submission of learned counsel for the petitioner is that save and except the confessional statement of co-accused,

Patna High Court CR. MISC. No.53028 of 2019(3) dt.06-11-2019 2/2 there is nothing against the petitioner and further there is no recovery from the petitioner and he has falsely been made accused in this case as well as in one more case. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura, in connection with Barbigha P.S. Case No. 105 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure (Vinod Kumar Sinha, J) sunilkumar/- U T
