The petitioner is accused in connection with Aurai P.S. Case No. 205 of 2014 (G.R. No. 4881 of 2014) registered under Section 379, 34 of the Indian Penal Code and later on, Section 411 of the I.P.C. has been added.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the theft Bolero vehicle was seized by the police, which was being driven by co-accused Chandan Rai and his associates Sarwan Yadav was also sitting in the vehicle. Both co-accused persons have confessed their guilt about theft of Bolero vehicle and they have said nothing against the petitioner in participation of the theft vehicle in question. In fact, on asking by the co-accused,

Patna High Court Cr.Misc. No.4484 of 2015 (3) dt.04-03-2015 2/2 Chandan Rai and Sarwan Yadav, the petitioner boarded in the vehicle, except that petitioner has no concern with the alleged offence. It is also submitted that petitioner has no criminal antecedent and he is in custody since 25.09.2014. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Ist Class, Muzaffarpur in connection with Aurai P.S. Case No. 205 of 2014 (G.R. No. 4881 of 2014). Out of two sureties, one surety must be parents/close relatives of the petitioner.
