The petitioner seeks bail in connection with Janta Bazar P. S. Case No.162 of 2017, instituted for the offences under Sections 272, 273, 308 of the Indian Penal Code and Sections 30(a), 41 of the Excise Act, 2016.

The learned counsel for the petitioner submits that the petitioner is in custody since 09.09.2021, charge-sheet has been submitted in this case and has antecedent of four cases. Allegation is of recovery of 2600 litre of spirit from a truck as detailed in the F.I.R.

The learned counsel for the petitioner submits that the petitioner was not arrested from the spot and his name was disclosed by Chaukidar Prabhunath Rai, out of previous enmity

Patna High Court CR. MISC. No.68334 of 2021(2) dt.18-02-2022 2/2 and the police also with the help of Prabhunath Rai got the petitioner implicated because of his antecedents. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in this case and was not arrested from the spot, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Saran at Chapra in connection with Janta Bazar P. S. Case No.162 of 2017. The application stands allowed.
