====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 11-09-2024 Heard learned Counsel for the petitioners and learned APP for the State.
2. The petitioners are apprehending arrest in connection with Patory P.S. Case No. 406 of 2015 registered on 28.09.2015 for the offences punishable under Sections 341, 323, 354, 379 and 147 of the Indian Penal Code and Section 3⁄4 of the Daain Act.
3. As per the prosecution, the FIR has been lodged against 13 named accused persons including the present
Patna High Court CR. MISC. No.61539 of 2024(2) dt.11-09-2024 2/3 petitioners against whom there is allegation that they all assaulted the informant and one of the co-accused persons snatched the chain of the informant.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel submits that entire allegation is general and omnibus and all the accused persons are family members. Counsel submits that the informant is the co-villager and gotiya of the accused persons. Counsel further submits that due to local village politics the name of the entire family members have come with allegation that the informant used to perform witchcraft. Counsel also submits that antecedent of the petitioners are clean.
5. Learned APP for the State opposes the prayer for bail and submits that there is nothing specific in the FIR.
6. In the present facts and circumstances, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Ist Class, Samastipur, in connection with
