JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 17-02-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Sherghati P.S. Case No. 76 of 2016 for the offences punishable under sections 272 and 273 of the I.P.C and section 47 A of the Excise Act. Allegedly, from the wine oven of the petitioner 100 liters of country made liquor, apparatus, eight drums containing Mahua and other articles were recovered which were destroyed. Submission is of false implication and that the field from where recovery has been made is of Panchu Yadav, copy of seizure list was not given to any family members of the petitioner,

Patna High Court Cr.Misc. No.3908 of 2017 (2) dt.17-02-2017 2/2 the seizure list witnesses are not the independent witnesses and as such the petitioner deserves sympathetic consideration. The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner by submitting that the petitioner was running the said wine manufacturing unit and he fled away after seeing the police party.

In the facts and circumstances as stated above, considering the allegation attributed against the petitioner, I am not inclined to grant privilege of pre-arrest bail to him and accordingly his such prayer stands rejected in connection with the aforementioned case pending in the court of A.C.J.M.
