Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Hisua P.S. Case No. 401 of 2022 registered for the offences punishable under Sections 30(a) of Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that petitioner had earlier moved this Court seeking anticipatory bail by filing Cr. Misc No. 42146 of 2024 and the same was allowed by an order dated 4-7-2024 with a direction to surrender within a period of six weeks from the date of order. It is next submitted that petitioner could not surrender within the time stipulated in the order dated 4-7-2024 in Cr. Misc No. 42146 of 2024, as such the petitioner filed a modification application being Cr. Misc
Patna High Court CR. MISC. No.58821 of 2025(2) dt.22-08-2025 2/2 No. 26098 of 2025 seeking extension of time for surrender but the same was permitted to be withdrawn by an order dated 18-42025. 4.
Learned APP, at this stage, submits that this is the second anticipatory bail application of the petitioner. 5.
Since this is the second anticipatory bail application of the petitioner as such the Court is not inclined to extend the privilege of anticipatory bail to the petitioner. 6.
Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
