According to the prosecution case itself, petitioner was going on by tractor along with informant and while they were on their way some unknown persons committed alleged crime. Petitioner has been dragged in this case as conspirator. Petitioner does not have any criminal antecedent.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri A. Samim, Judicial Magistrate, Ist Class, Bhagalpur/concerned court in Kahalgaon (Shiv Narayanpur) P.S. Case no. 353/2014.
