The petitioners being mother and brother of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Section 304B/34 of the Indian Penal Code.

The accusation is of killing the daughter of the

Patna High Court Cr.Misc. No.50323 of 2014 (3) dt.27-04-2015 2/2 informant after 8 months of the marriage due to non-fulfillment of dowry demand. Admittedly the informant died due to burn injuries.

It is submitted by learned counsel for the petitioners that for the occurrence of 14.12.2013, the FIR was registered 08.01.2014 after gap of 26 days. It is further submitted that the victim was provided medical assistance which transpired during investigation, moreover, the informant has retracted from initial version and has filed a petition to that effect before the learned court below.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Majhaulia P.S. Case No.09 of 2014, pending before the learned Chief Judicial Magistrate, West Champaran, Bettiah.

With the above observation, both these applications are, accordingly, disposed off.
