JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-03-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioner apprehends their arrest in connection with Saharsa Sadar P.S. Case No. 784 of 2016 registered under Sections 147, 148, 149, 323, 324, 307, 379 and 354 of the Indian Penal Code.

The accusation is that six persons, named in the First Information Report having armed with lathi , Khanti, reached at the house of the informant and started to abuse and, on protect made by the informant Mukesh Kumar, he was assaulted by petitioner No. 1 with bricks. When the cousin of the informant rushed to save him then he was assaulted by Suraj Choudhary

Patna High Court Cr.Misc. No.2559 of 2017 (2) dt.07-03-2017 2/2 through Khanti and Rajiv Choudahry also caused assault to him. Phula Devi, Surendra Rajak, mother and father of the informant reached there then mother of the informant was laid on the ground by petitioner No. 2 and petitioner No. 3 and her cloth was turned and petitioner No. 2 snatched gold chain from her neck. Petitioner No. 4 caused injury at the head of Surendra Choudahry, father of the informant.

Learned counsel for the petitioners submits that the injuries on the person of the informant and cousin of the informant are simple in nature and no injury was found to father of the informant. The petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No.784 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
