JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code. Petitioner was arrested in connection with Laheri P.S. Case No. 228 of 2015 and was remanded in the aforesaid case on 14.09.2015 and one mobile is said to have been recovered from possession of the petitioner when he was arrested in the above stated case. Petitioner confessed his guilt and accepted his involvement in the present crime and after that the house of the petitioner was raided and laptop of Dell company and one golden locket were recovered from the house of the petitioner.

Patna High Court Cr.Misc. No.16661 of 2016 (2) dt.27-04-2016 2/2 Learned counsel for the petitioner submits that aforesaid recovery was made in absence of the petitioner and moreover, seized articles belonged to the petitioner and no person came forward to claim his ownership in respect of the seized articles.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bihar P.S. Case No. 386 of 2015.
