JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 33 and 41 of the Indian Forest Act.
It is alleged that while putting the logs of simal tree into a pit, accused persons managed to escape but the petitioner was identified.
It is submitted by learned counsel for the petitioner that though, the case was instituted in the year 2003, but the cognizance has been taken in the year 2010. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Patna High Court Cr.Misc. No.4393 of 2015 (2) dt.03-02-2015 2/2 Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Case No. C.C. 208 of 2003 pending in the court of learned JM, 1st Class, Araria Accordingly, the application is disposed of.
