ANJANA MISHRA ORAL ORDER 02-08-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 16.05.2018 in connection with Bihta P.S. Case No.517 of 2018 registered for the offence under Sections 147, 148, 149, 448, 354B, 341, 323, 380 and 307 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that for a small piece of disputed land, the informant's side as well as the petitioner has been litigating and there was an altercation with regard to some piece of land. The petitioner has registered Bihta P.S. Case No. 518 of 2018, making same and similar allegation whereas the informant of the present case
Patna High Court Cr.Misc. No.42513 of 2018 (4) dt.02-08-2018 2/2 has registered Bihta P.S. Case No.517 of 2018 under similar sections.
Considering the aforementioned facts and circumstances and because similarly situated co-accused Chiku Kumar has since been extended the privilege of anticipatory bail in Cr. Misc. No.42335 of 2018, vide order dated 20.07.2018, and also because the petitioner is not having any criminal antecedent, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Danapur, in connection with Bihta P.S. Case No.517 of 2018.
