JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-02-2017 Heard learned counsel for the petitioners, learned counsel appearing on behalf of the informant and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Khagaria P.S. Case no. 279 of 2016, registered under Sections 452, 498A, 307, 504, 506 and 313/34 of the Indian Penal Code and Section 3 and 4 of the Dowry Prohibition Act. The accusation is of torturing of the daughter of the informant due to non-fulfillment of demand of dowry and also got aborted the pregnancy of two and half months of his daughter by her husband, mother-in-law and Nanad.
Learned counsel for the petitioners submits that it would appear from the F.I.R. itself that the case has been lodged by the father of the victim and the petitioners, who are married Nanad and
Patna High Court Cr.Misc. No.2402 of 2017 (2) dt.14-02-2017 2/2 Nandoshi of the victim have falsely been implicated in this case. Further submission is that the petitioners are not beneficial in case of providing the dowry by the informant to the in-laws of the victim. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S. Case No. 279 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
