The petitioner seeks bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code, but the charge-sheet has been submitted under Sections 395 and 412.
The learned counsel for the petitioner submits that the petitioner is in custody since 18.01.2021, charge-sheet has been submitted in the case and has antecedent of six cases. The learned counsel for the petitioner submits that the informant alleges that 6-7 unknown criminals entered the bank and looted Rs.18,00,000/- on 05.06.2018 at 9.50 A.M. and also assaulted the employees during the course of robbery.

No.67119 of 2021(2) dt.19-04-2022 2/3 The learned counsel for the petitioner submits that the F.I.R. was against unknown and petitioner has been falsely implicated based on his antecedents in pursuance of the confessional statement made by Pankaj Kumar Pandit @ Pankaj Kumar. It is further submitted that the accused in whose confessional statement, the name of this petitioner transpired has been granted bail by order dated 27.03.2019 in Cr. Misc. No.18560 of 2019. It is also submitted that co-accused Raj Kapoor Kumar Sah @ Raj Kapur Sah has also been granted bail by order dated 14.10.2019 in Cr. Misc. No.63095 of 2019. The learned counsel for the petitioner further submits that except for confession, there is nothing in the investigation to even remotely connect the petitioner with the offence.
The learned A.P.P. for the State opposes the bail application and submits that the petitioner has antecedent of six cases.
Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and co-accused have been granted bail, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court
Patna High Court CR. MISC. No.67119 of 2021(2) dt.19-04-2022 3/3 below where the case is pending in connection with Kudhni P. S. Case No.269 of 2018, subject to condition that one of the bailors shall be the father of the petitioner namely, Shyam Narayan Thakur. Further the petitioner will have to mark his attendance before the concerned police station in between 01st to 06th of every month commencing from May, 2022, till the charges are not framed. In the event, the concerned police station reports to the learned Court below that petitioner has violated the condition imposed as aforesaid in any of the month before framing of charge, the learned Court below will be at liberty to cancel his bail bonds.
The application stands allowed.
