The petitioner seeks bail in a case registered under sections 364/120(B) of the Indian Penal Code later on section 302 I.P.C. was also added.

Petitioner is not named in the first information report. The informant alleged that some body called his son and thereafter his son did not return. The informant disclosed the mobile number by which his son was called and ransom was demanded.

It is submitted that there is absolutely no evidence against the petitioner except the confessional statement of co-accused. Even the police did not trace out the mobile number from which the call was made and ransom was demanded.

Patna High Court Cr.Misc. No.4546 of 2015 (3) dt.26-02-2015 2/2 On perusal of the record it appears that except the confessional statement there is no other material to connect the involvement of the petitioner in killing the son of the informant. Considering the aforesaid fact , the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in Lakhisarai P.S.
